MEL’S MEALS WEBSITE TERMS AND CONDITIONS
Effective Date: August 31, 2026
These Terms and Conditions (“Terms”) govern use of the Mel’s Meals websites located at melsmeals.co and melsmealstexas.com (collectively, the “Website”), as well as purchases, meal plans, subscriptions, beverages, pickup, delivery, promotions, loyalty credits, and other products and services offered by Mel’s Meals.
By accessing or using the Website, creating an account, submitting information, placing an order, enrolling in a meal plan, clicking an acceptance checkbox, paying an invoice, or otherwise purchasing products or services from Mel’s Meals, you agree to these Terms and all policies expressly incorporated into them.
1. Acceptance of Terms
By using the Website or purchasing products or services from Mel’s Meals, you acknowledge that you have read, understand, and agree to these Terms, the Mel’s Meals Privacy Policy, applicable order or meal-plan documentation, and any other policy expressly incorporated into your transaction.
Where checkout acceptance is required, you must affirmatively accept these Terms before completing your purchase.
If you do not agree to these Terms, you should not use the Website or place an order.
2. Eligibility and Customer Information
Customers must be at least eighteen (18) years old and legally capable of entering into a binding agreement, or a parent or legal guardian must make the purchase on behalf of a minor.
Customers must provide complete and accurate contact, billing, payment, delivery, pickup, and account information and promptly update information that changes.
If customer accounts are offered, customers are responsible for maintaining the confidentiality of their login credentials and for activity occurring through their account.
3. Mel’s Meals Services
Mel’s Meals may offer prepared meals, individual orders, recurring meal plans, family meal plans, refreshers, wellness beverages, juices, teas, other prepared beverages, catering, pickup, delivery, promotions, special orders, and other food or beverage products and services from time to time.
Available products, menus, quantities, ingredients, meal-plan structures, delivery methods, pickup options, and services may change based on availability, seasonality, operational capacity, supplier conditions, quality standards, or business needs.
4. Meal Plans
Mel’s Meals currently offers or may offer Weekly Meal Plans, Monthly Meal Plans, Family Monthly Plans, promotional plans, and other meal plans established from time to time.
The specific meals, quantities, schedule, price, billing frequency, and other commercial terms applicable to a meal plan will be stated in the customer’s meal-plan documentation, order form, checkout page, invoice, confirmation, or other applicable purchasing materials.
Those plan-specific materials are incorporated into these Terms.
Prices and plan structures are not guaranteed indefinitely and may be changed prospectively in accordance with these Terms and applicable law.
5. Recurring Billing and Automatic Renewal
Mel’s Meals meal plans automatically renew unless the applicable plan documentation expressly states otherwise.
By enrolling in a recurring meal plan, the customer authorizes Mel’s Meals and its authorized payment processors to charge the payment method associated with the customer’s account at the billing frequency disclosed for that plan.
Recurring charges will continue until the plan is properly canceled.
Customers are responsible for reviewing the applicable meal-plan documentation for the plan’s billing schedule and then-current price.
Material changes to a recurring plan’s price or terms will be communicated when required by applicable law or reasonably appropriate before the changed terms apply to a future renewal.
6. Orders and Order Acceptance
All orders are subject to acceptance, availability, payment authorization, and operational capacity.
Mel’s Meals may reject, modify, or cancel an order when reasonably necessary because of product or ingredient shortages, pricing errors, payment problems, suspected fraud, delivery limitations, safety concerns, severe weather, utility interruption, equipment failure, production issues, legal or regulatory restrictions, or other legitimate business reasons.
If Mel’s Meals cancels a paid order that cannot be fulfilled and no mutually acceptable substitute or credit is provided, Mel’s Meals will issue any refund properly due.
7. Order Deadlines, Modifications, Pauses, and Cancellations
Requests to cancel, pause, or materially modify a recurring meal plan must be received at least seventy-two (72) hours before the next applicable billing or production cycle to prevent that upcoming cycle from being processed.
Requests received after the cutoff may apply to the following billing or production cycle.
Once ingredients, staffing, scheduling, production, or other resources have been committed, Mel’s Meals may decline a requested modification or apply it to a future cycle.
A cancellation stops future renewals but does not automatically entitle the customer to a refund for a period already purchased.
Once a paid service period has begun, Mel’s Meals generally does not issue prorated refunds, although the customer remains entitled to fulfillment of the paid period unless otherwise agreed or fulfillment becomes impracticable.
8. Prices, Taxes, and Payment
Current prices will be disclosed through the applicable order form, checkout process, invoice, meal-plan documentation, or other customer-facing materials.
Applicable sales tax, delivery charges, service charges, redelivery charges, or other disclosed fees may be added where appropriate.
By submitting a payment method, the customer represents that the customer is authorized to use it and authorizes Mel’s Meals and its authorized payment processors to charge amounts properly due for purchases and recurring meal-plan renewals.
9. Failed and Declined Payments
If a payment is declined, reversed, expired, returned, disputed, or otherwise cannot be processed, Mel’s Meals may suspend fulfillment, retry an authorized payment as permitted, request updated payment information, place the account on hold, cancel an order, suspend a meal plan, or terminate future service.
Mel’s Meals is not required to prepare, release, deliver, or continue providing products or services for which required payment has not been successfully received.
10. Refund, Credit, and Replacement Policy
Because Mel’s Meals sells perishable and often custom-prepared food and beverages, completed orders are generally final once prepared, delivered, or made available for pickup.
Mel’s Meals may, depending on the circumstances, provide a replacement, replacement order, account credit, courtesy credit, partial refund, or full refund.
Refunds or credits may be appropriate for duplicate charges, verified order errors, products Mel’s Meals cannot fulfill, or other circumstances determined appropriate by management.
Refunds are generally not provided solely because of personal taste, changed preferences, failure to consume a product, failure to retrieve a delivery, improper refrigeration, improper reheating, improper storage, or cancellation after an applicable cutoff.
Nothing in this section limits customer rights that cannot legally be waived.
11. Mel’s Meals Loyalty Credits
Under the current Mel’s Meals loyalty program, a customer who completes two qualifying Family Monthly Plan purchases earns a $75 Mel’s Meals Loyalty Credit.
The credit may be applied toward a future Mel’s Meals order or a future Family Monthly Plan purchase.
Unless otherwise expressly stated:
the credit has no cash value;
the credit is non-refundable;
the credit is non-transferable;
the credit may not be sold or exchanged for cash;
the credit may not reduce an order total below zero; and
promotional stacking may be restricted.
The current $75 Loyalty Credit does not expire while the applicable loyalty program remains active.
Mel’s Meals may prospectively modify or discontinue the loyalty program. Credits already validly earned will be handled according to the terms under which they were earned and applicable law.
12. Menu and Ingredient Changes
Menus, recipes, sides, ingredients, beverages, portion configurations, packaging, and product availability may change because of seasonality, supplier availability, quality standards, safety considerations, or operational needs.
Mel’s Meals may make reasonable substitutions without individual advance approval where the substituted item is reasonably comparable in quality or value.
Mel’s Meals will not knowingly make a substitution that materially changes disclosed allergen information or an accepted dietary restriction without taking appropriate precautions.
13. Food Allergies and Allergen Cross-Contact
Mel’s Meals is not an allergen-free facility.
Meals and beverages may contain or come into contact with the nine major food allergens recognized under federal law:
milk;
eggs;
fish;
crustacean shellfish;
tree nuts;
peanuts;
wheat;
soybeans; and
sesame.
Products may also contain other ingredients capable of causing allergic reactions or sensitivities.
Although Mel’s Meals takes reasonable precautions to reduce allergen cross-contact, Mel’s Meals cannot guarantee that any product is completely free from allergens or allergen cross-contact.
Customers with severe or life-threatening food allergies should exercise caution before consuming Mel’s Meals products and should review available ingredient and allergen information.
Mel’s Meals employees may not guarantee that a product is allergen-free unless Mel’s Meals has specifically made that representation in writing for that product and production process.
Prepared beverages may also contain allergens or ingredients requiring refrigeration. Customers are responsible for reviewing ingredient information, following storage instructions, and considering personal dietary sensitivities before consumption.
14. Dietary Preferences and Medical Conditions
Mel’s Meals provides wellness-oriented meals and beverages for general consumption.
Unless expressly stated otherwise for a specific program, Mel’s Meals does not provide medical nutrition therapy, diagnosis, treatment, disease management, individualized medical dietary services, or medical advice.
Customers with diabetes, kidney disease, heart disease, allergies, pregnancy-related dietary concerns, or other medical conditions should consult an appropriate licensed healthcare professional regarding their individual dietary needs.
Customer requests involving dietary preferences or ingredient exclusions are subject to availability and acceptance by Mel’s Meals.
15. Nutrition Information
Any nutritional information, calorie information, macronutrient information, serving information, or similar information provided by Mel’s Meals is intended for general informational purposes unless expressly identified as laboratory-tested, professionally certified, or otherwise verified.
Nutritional values may be estimates based on recipes, supplier information, ingredient databases, software, preparation methods, or standard serving sizes.
Actual values may vary because of ingredient substitutions, portion differences, supplier changes, preparation methods, or other normal production variations.
16. Customer Food-Safety Responsibilities
Customers are responsible for promptly retrieving, refrigerating, freezing, storing, reheating, and consuming meals and beverages according to package instructions, storage directions, use-by guidance, and ordinary food-safety practices.
Mel’s Meals is not responsible for quality deterioration, spoilage, or food-safety concerns caused by customer mishandling after successful delivery or pickup.
Customers should not consume products they reasonably believe may be spoiled, contaminated, improperly stored, or otherwise unsafe.
17. Delivery
Mel’s Meals may deliver through its own personnel or through third-party delivery providers, including Uber, DoorDash, or other available delivery services.
Delivery is generally available where Mel’s Meals can reasonably obtain appropriate delivery service.
Delivery availability may vary depending on customer location, driver availability, distance, delivery-platform coverage, weather, traffic, order size, production capacity, safety considerations, or other circumstances.
Delivery dates and times are estimates unless Mel’s Meals expressly guarantees a specific time in writing.
Customers must provide complete and accurate delivery information, including the address, apartment or unit number, access instructions, gate codes, recipient information, and telephone number where applicable.
Mel’s Meals is not responsible for delivery failure caused by incorrect, incomplete, or outdated information supplied by the customer.
Orders may be left unattended at the designated delivery location when reasonably appropriate.
Once an order has been successfully delivered according to the customer’s instructions, responsibility for timely retrieval, refrigeration, storage, and safeguarding of the product transfers to the customer.
18. Pickup
Customer pickup may be available for eligible orders.
Customers must retrieve orders during the designated pickup period or according to other arrangements confirmed by Mel’s Meals.
Mel’s Meals may require order verification or identification before releasing certain orders.
Once an order is made available for pickup, failure to retrieve it does not automatically create a right to a refund.
Perishable products that cannot safely be held beyond their appropriate food-safety period may be discarded.
19. Delivery Problems and Missing Orders
Customers should inspect orders promptly upon receipt.
Missing, incorrect, damaged, visibly compromised, or potentially spoiled products should generally be reported to Mel’s Meals within twenty-four (24) hours after delivery or pickup.
Mel’s Meals may request the order number, photographs, packaging, labels, batch information, delivery information, or other reasonable documentation necessary to investigate the issue.
Failure to promptly report an ordinary order problem may limit Mel’s Meals’ ability to investigate or provide a replacement, refund, or credit.
This reporting period does not waive rights that applicable law does not permit Mel’s Meals to limit.
20. Food Quality or Safety Complaints
Customers should promptly report suspected contamination, foodborne illness, allergen exposure, foreign objects, packaging failures, or other food-safety concerns.
When reasonably and safely possible, customers should preserve:
the remaining product;
packaging;
labels;
batch information;
photographs;
order information; and
relevant delivery or pickup information.
Customers should not consume any product reasonably suspected of being unsafe.
Mel’s Meals may investigate complaints using batch, production, ingredient, supplier, labeling, delivery, temperature, and other operational records.
A customer report of illness or another adverse event does not, by itself, establish that a Mel’s Meals product caused the reported condition.
21. Promotions and Promotional Codes
Promotions, discount codes, referral offers, limited-time offers, and other incentives may be subject to eligibility requirements, expiration dates, redemption limits, product restrictions, geographic restrictions, minimum purchases, or other terms.
Unless expressly stated otherwise, promotions may not be combined or stacked.
Promotional value has no cash value and may not be transferred, sold, duplicated, or fraudulently manipulated.
Mel’s Meals may refuse or cancel promotional use involving fraud, duplication, manipulation, abuse, or obvious pricing or system errors.
22. Gift Cards and Account Credits
Gift cards, gift balances, store credits, account credits, or similar value may be offered from time to time and are subject to the terms disclosed when issued.
Unless applicable law requires otherwise, such amounts are not redeemable for cash, may not be resold, and may be subject to reasonable redemption restrictions.
Expiration rules, if any, will comply with applicable law and the terms disclosed when the credit or gift value is issued.
23. Intellectual Property
The Website and Mel’s Meals materials may contain trademarks, service marks, trade names, logos, product names, photographs, menus, graphics, designs, written content, recipes, proprietary recipe information, marketing content, and other intellectual property owned by or licensed to Mel’s Meals.
Use of the Website or purchase of a product does not transfer ownership of Mel’s Meals intellectual property.
No Mel’s Meals content may be copied, reproduced, republished, distributed, commercially exploited, or used to create derivative commercial materials without authorization except as permitted by law.
24. Acceptable Website Use
Customers may use the Website only for lawful purposes.
Users may not:
-attempt unauthorized access to accounts, systems, or data;
-interfere with Website operation;
-introduce malware or malicious code;
-impersonate another person or business;
-submit fraudulent information;
-use stolen payment information;
-manipulate promotions or credits;
-scrape or systematically extract protected Website content without authorization;
-infringe intellectual-property rights; or
-use the Website in violation of applicable law.
Mel’s Meals may restrict or terminate access for misuse.
25. Customer Reviews and Submitted Content
Customers may voluntarily submit reviews, comments, photographs, suggestions, feedback, testimonials, or other content through channels made available by Mel’s Meals.
Customers may not submit unlawful, fraudulent, threatening, defamatory, infringing, intentionally false, or malicious content.
By submitting ordinary written feedback, the customer permits Mel’s Meals to use that feedback for legitimate business purposes, subject to applicable law.
Submission of a photograph, review, or other content does not automatically authorize Mel’s Meals to use a customer’s name, image, likeness, or testimonial in paid advertising where separate consent is legally required.
26. Third-Party Services
Mel’s Meals may use third-party providers for payment processing, customer relationship management, website hosting, analytics, email, SMS messaging, delivery, social media, security, accounting, and other business functions.
Third-party services may be governed by their own terms and privacy practices.
Mel’s Meals is not responsible for independent acts, omissions, outages, or practices of third parties outside Mel’s Meals’ reasonable control.
27. Electronic Communications
By doing business with Mel’s Meals, customers consent to receive communications reasonably necessary to administer their order, payment, delivery, pickup, meal plan, account, cancellation, customer-service inquiry, safety notice, or other transaction.
Transactional communications may be sent even when a customer has opted out of promotional communications where those communications are reasonably necessary to administer an active transaction or customer relationship.
Marketing communications are handled separately and remain subject to applicable consent and opt-out requirements.
28. SMS/Text Messaging
By voluntarily opting in to receive SMS or MMS messages from Mel’s Meals, customers consent to receive messages at the mobile number provided. Messages may include order confirmations, delivery or pickup updates, meal-plan notices, customer-service communications, reminders, and promotional messages where separate marketing consent has been provided. Message frequency may vary. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchase. Customers may reply STOP to opt out of applicable text messages and HELP for assistance. Opting out of marketing messages does not cancel a meal plan or prevent necessary transactional communications where permitted by law.
29. Privacy
Mel’s Meals collects, uses, retains, and discloses personal information in accordance with the Mel’s Meals Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference and is available through the Website.
30. Disclaimers
To the fullest extent permitted by applicable law, the Website, products, and services are provided subject to the warranties expressly required by law and any warranties expressly made by Mel’s Meals.
Mel’s Meals does not guarantee uninterrupted Website availability, uninterrupted third-party delivery availability, continuous availability of any particular menu item or ingredient, or that every product photograph will exactly reflect the final prepared product.
Nothing in these Terms excludes any warranty, statutory right, or consumer protection that cannot lawfully be excluded.
31. Limitation of Liability
To the fullest extent permitted by applicable law, Mel’s Meals will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Website or purchase of Mel’s Meals products or services where such damages may legally be excluded.
To the fullest extent permitted by law, Mel’s Meals’ aggregate liability arising from a particular order or transaction will not exceed the amount actually paid to Mel’s Meals for the order or transaction giving rise to the claim.
This limitation does not apply to liability that applicable law does not permit Mel’s Meals to limit or exclude.
32. Indemnification
To the extent permitted by applicable law, customers agree to be responsible for losses, liabilities, damages, claims, or reasonable costs arising from their unlawful misuse of the Website, fraudulent conduct, intentional misconduct, unauthorized use of another person’s payment method or information, infringement of third-party rights, or material violation of these Terms.
This provision does not require a customer to indemnify Mel’s Meals for liability that applicable law places on Mel’s Meals.
33. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law or another controlling law applies.
Before initiating formal legal proceedings, customers and Mel’s Meals are encouraged to make a reasonable good-faith effort to resolve the dispute directly.
Subject to applicable jurisdictional requirements and rights that cannot legally be waived, legal proceedings concerning these Terms or a Mel’s Meals transaction shall be brought in an appropriate court located in Brazoria County, Texas.
These Terms do not presently require mandatory arbitration.
34. Force Majeure
Mel’s Meals is not responsible for delays, interruptions, substitutions, or inability to perform caused by circumstances reasonably beyond its control.
Such circumstances may include hurricanes, tropical storms, flooding, freezes, severe weather, fire, power failure, water interruption, refrigeration or equipment failure, utility disruption, transportation interruption, road closures, driver shortages, supplier failures, ingredient shortages, governmental orders, public-health emergencies, labor interruptions, technology outages, or similar events.
Where reasonably possible, Mel’s Meals may reschedule fulfillment, substitute products, issue credits, cancel affected orders, or take other reasonable corrective action.
35. Changes to the Terms
Mel’s Meals may revise these Terms from time to time.
Revised Terms may be posted on the Website with an updated effective date and generally apply prospectively.
When a material change affects an existing recurring meal plan, Mel’s Meals will provide notice when required by applicable law or when reasonably appropriate before the changed provision applies to a future renewal.
Continued use of the Website after revised Website-use terms become effective constitutes acceptance of those revised terms to the extent permitted by law.
A completed transaction remains subject to any rights that vested under the terms applicable when that transaction occurred.
36. Severability, Waiver, and Entire Agreement
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed as appropriate, and the remaining provisions will remain in effect.
Failure by Mel’s Meals to enforce a provision on one occasion does not waive the right to enforce that provision later.
These Terms, together with the Privacy Policy, applicable order documentation, meal-plan documentation, invoice terms, and any policy expressly incorporated into a transaction, constitute the agreement governing the applicable Mel’s Meals transaction.
If specific meal-plan or order documentation conflicts with these general Terms regarding quantity, billing period, price, or another transaction-specific commercial term, the more specific transaction documentation controls for that issue.
